The Mulligan Defense ("we," "us") is a criminal defense and DUI law firm in La Quinta, California. This policy explains what information we collect through mulligandefense.com (the "Site"), how we use it, who we share it with, and the choices you have.

We keep this simple: we collect what you choose to send us, plus basic website usage data. We do not sell your personal information.

Contacting us does not make you a client

Sending us a message through the Site, by email, or by phone does not create an attorney-client relationship. We only represent you after we have both agreed to it, usually in a signed fee agreement.

Please do not send confidential or sensitive details about your case (what happened, what you told police, evidence, or anything you would not want others to see) through the contact form or email before we have spoken. A short note with your name, the best way to reach you, and the general type of case is enough. Website forms and ordinary email are convenient, but they are not the most secure way to share private information.

Information we collect

Information you give us:

  • Contact form: first name, last name, email address, phone number, and your message.
  • Email: your email address and whatever you include in your message.
  • Phone calls and text messages: your phone number and anything you tell us, text us, or leave in a voicemail or message.

Information collected automatically when you visit the Site:

  • Device and browser details, such as browser type, operating system, screen size, and language.
  • General location (city or region) estimated from your IP address.
  • How you use the Site, such as pages viewed, time on page, the website or search that referred you, and whether you started or submitted the contact form.
  • Whether you tapped one of our phone number links. We record that the link was tapped and which link it was. We do not record your phone number or anything about the call itself.

We do not ask for, and you should not send through the Site, Social Security numbers, financial account numbers, or similar sensitive identifiers.

How we use information

  • To respond to you, schedule a consultation, and decide whether we can help with your matter.
  • To check for conflicts of interest before taking a case, as the rules for lawyers require.
  • To understand how people find and use the Site, so we can improve its content and make it easier to reach us.
  • To keep the Site working and secure, and to prevent spam and misuse.
  • To meet our legal and professional obligations.

We do not use your information to send marketing emails or texts, and we do not sell it or rent it to anyone.

Cookies and analytics

The Site uses Google Analytics, loaded through Google Tag Manager, to measure traffic. Google Analytics uses cookies and similar technologies to count visits and see how pages are used. It gives us summary reports, not your name. You can learn how Google uses this data at How Google uses information from sites that use its services, and you can opt out with the Google Analytics Opt-out Browser Add-on.

Some parts of the Site come from other companies and may set their own cookies or collect usage data when they load:

  • A Google reviews display provided by Featurable.
  • Videos hosted on YouTube, which load when you choose to play them.
  • Other analytics or advertising tools we may add through Google Tag Manager from time to time.

You can block or delete cookies in your browser settings. The Site will still work, though some features, like video, may not.

Do Not Track: browsers send Do Not Track signals inconsistently and there is no common standard for them, so the Site does not currently respond to them. If we ever sell or share personal information for targeted advertising, we will honor Global Privacy Control signals as an opt-out.

Who we share information with

We share personal information only as needed to run the firm and the Site:

  • Service providers that host or support our work, such as our website host (Webflow, which receives and stores contact form submissions), our email and file storage provider, our analytics provider (Google), and other providers that help us run the firm, such as phone, answering, scheduling, case management, or billing services. They may use the information only to provide their services to us.
  • When the law requires it, such as to comply with a valid court order or subpoena, and only to the extent the law and our duty of confidentiality allow.
  • To protect our rights or the safety of others, where the law permits.
  • If the firm is ever merged, sold, or transferred, to the successor, subject to our professional duties to clients.

We do not sell personal information, and we do not share it with other companies for their own marketing.

How long we keep information, and how we protect it

  • Inquiries that don't become cases: we keep them as long as reasonably needed to check conflicts of interest and keep a record of who contacted us, and as long as the law and State Bar rules require.
  • Client files: we keep them as long as our professional obligations and the law require.
  • Analytics data: Google Analytics keeps detailed visit data only for a limited period set in our account, after which only summary reports remain.

We use reasonable safeguards, such as password-protected accounts and services with built-in security, to protect the information we hold. No website or email system is completely secure, which is one more reason not to send confidential case details through the Site.

Your California privacy rights

You may ask us to:

  • Tell you what personal information we have about you and how we use it.
  • Correct information that is wrong.
  • Delete information about you, unless we need to keep it, for example to meet our professional or legal obligations, to check conflicts of interest, or because it is part of a client file.

To make a request, email josh@mulligandefense.com or call 760-777-4322. We may need to confirm your identity before acting on a request. We will not treat you differently for making one.

California "Shine the Light" law (Civil Code section 1798.83): we do not share personal information with third parties for their own direct marketing.

Google data used by our internal reporting tool

The firm uses a small internal tool to track how the Site performs in search. Only the firm's own staff sign in to it. It is not offered to the public, and it does not access any Site visitor's or client's Google account.

When a firm account signs in with Google, the tool may:

  • Read Google Search Console data for websites the firm owns, such as search queries, clicks, impressions, and page positions.
  • Read Google Analytics reports for the firm's own Analytics property, such as visits, traffic sources, and pages viewed.
  • Write those results to a Google Sheet in the firm's own Google Drive, and run scheduled updates of that Sheet.

The tool uses this data only to create internal reports for the firm. It does not sell the data, use it for advertising, or transfer it to anyone else, except to the extent the firm's own service providers host it. It does not use the data to develop, improve, or train generalized artificial intelligence or machine learning models. The tool's use of information received from Google APIs follows the Google API Services User Data Policy, including its Limited Use requirements.

A firm user can remove the tool's access at any time from their Google Account's security settings.

Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from them through the Site. If you believe a child under 13 has sent us information through the Site, contact us and we will delete it.

Links to other websites

The Site links to other websites, such as review sites, social media, court and government pages, and map services. Their own privacy policies apply when you visit them, not this one.

Changes to this policy

We may update this policy from time to time. When we do, we will post the new version on this page and change the effective date at the top.
